How to Apply for an Owner-Occupancy Exemption

Properties of two or three units may qualify for a temporary use exemption from the Rent Control Law. To qualify, the applicant must meet certain criteria. This exemption is not automatic; it can only be granted by the Board.

Eligibility Requirements

  1. The property must consist of two or three units.
  2. You must own at least a 50% interest in the property as a natural person(s) as of the date the application for exemption is filed.
  3. You must have continuously resided at the property as your principal place of residence beginning at least 120 days before the date the application is filed.

If you would rather get a paper application from us, please email us at rentcontrol@santamonica.gov or call (310) 458-8751 during business hours to request that an application be mailed to you.

  2. Show Proof of Ownership

    Attach a copy of the grant deed with the stamp showing the recording date.  A grant deed showing the applicant’s ownership interest in the property must accompany the application.  

  3. Show Proof of Residency

    Attach all required documents showing proof that you currently live on the property as your principal place of residence and have done so for at least 4 months prior to filing the application.

  4. Enclose Payment

    Be sure to enclose a check for the $100 processing fee payable to Santa Monica Rent Control.

  5. Mail Completed Application

    Mail completed application and copies of required documentation to the address on the form.

  6. Complete a California Levine Act Disclosure Form

    California law prohibits City Officers, including Rent Control Board commissioners from participating in any proceeding involving a contract, license, permit, or other entitlement for use if such Officer received campaign contributions totaling more than $250 within the previous twelve months, and for twelve months following the date of a final decision, from a party or participant to the proceeding, or their agent. Please complete this Levine Act Disclosure Form to disclose whether or not you have made any such contribution.
